Today, on June 27, 2025, Egale Canada and Skipping Stone are thrilled to share that the Court of King’s Bench of Alberta has granted our injunction request to block the Government of Alberta’s denial of gender-affirming care for gender diverse young people in the province from coming into effect. This is an historic win, affirming that young people in Alberta and across Canada deserve to live authentically in safety and freedom.
On the basis of expert evidence, the Court concluded that Bill 26 would cause irreparable harm to gender diverse young people in Alberta. The Court recognized that, in addition to other harms, barring medical care for gender diverse young people would “reinforce the discrimination and prejudice that they are already subjected to”. The Court further concluded, “The evidence shows that there is a benefit to the public in issuing the injunction because it will allow this marginalized group to continue receiving medical care from trusted doctors and a broader team of health professionals thereby avoiding the adverse consequences the ban will have on them, including interference with their autonomy, unwanted and permanent development, serious stress and anxiety and further discrimination, until the issues are decided on a full record at trial. “
As we have long argued, the government should never interfere in the medical decisions of doctors and patients or prevent parents and youth from deciding what medical care is right for them. Everyone deserves the ability to access health care and participate fully in their communities. We are grateful that the Court has acted to protect access to critical medical care.
